My situation is very unusual. I got a notification that the case is here.
�On March 26, 2008, we transferred this case to our SALT LAKE CITY, UT location to conduct the interview that is a standard part of processing�
Another notification on 04/15/08 is �The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office.�
I went to SLC immigration office yesterday and the officer told me they don�t have my case and it is in national benefit center and that�s all. He didn�t tell anything more. Then, I call the general line and was transferred to the national benefit center. They told me that the case came back from Salt Lake on 04/15 and I will know a decision in about 60 days which is very generic message. Then, I asked what happened to the interview, he said the application was reviewed and came back with the reviewer note. He didn�t say much why no interview was conducted. He said someone else in the National Benefit Center will review the case to make a decision.
Now, I am very confused on what is going on. I read a lot of posting in different immigration forum last night. It seems very unusual to me. I couldn�t find any case came to local office and then went back to NBC without an interview.
I hope someone can tell me what is going on.

There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.
On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

I can also see that the LUD on both my and my wife's 485 applications have changed. It happened on 4th feb i guess (that's when i got the notification).
As 'bostonian' mentions this can be a fingerprinting update or may be zipping and archiving of our files for all we know ;) (just kidding)

Hi,
My first 3 year of H-1 is about to expire in October 2009.
My employer is planning to apply for extension by premium processing in the next few weeks.
My question:
What if the H1 extension is rejected? Am I considered to be in legal status till October? I hope the original H1 is still in good position till October even though if my employer filing of extension is rejected.
Please help with your answers.

As long as New Job and Old Job are SAME/SIMILAR and assuming your I-40 is approved & 180 days passed, you should be perfectly fine.

THEN
its better to file AC21
ELSE
just keep quite till CIS sends a letter

Hi
My H1b was approved in feb 2010 for location A.Before I could start working at location A,my company found a better client (close to home,better pay) at location B .(different state).
what should my company do or have done with regards to lca for me to work at location b.
should lca have been approved before I moved to location b or could it be filed after i started working at location b. If lca was filed after I started working, is that ok.If not, how do we correct this.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. I am planning on accepting a full time position at client.I did not start with them yet. Client's lawyer is planning on applying for the PERM application and recruitment has already finished. My question is
Since I am yet to join the client, should the question in PERM application "Has the job been offered to foreign national " be set to Yes or No. Clients lawyer says we can leave it as "No"(Since I did not start with them yet) but chances of getting Denial because of this question are high. Should I join the client and then file for PERM or Is it OK to set it as "No" and hope it will get approved.I am planning on joining the client in couple of months.

It has limited relevance, the issue is the integrity of the Senator, he has admitted to the issue at hand but he went on the Senate floor as an elected public official to make declaratory and restrictionist anti-immigration statements, attacked immigrants, proposed and supported anti-immigrant ammendments and all this with the foundation of his positive public image, integrity and moral uprightness. We are thus not discussing the list he is on, but are simply taking note of the Senator's credibility on an issue that affects us. Anything beyond that would be inappropriate and not relevant to our issues.

Fedex usually does not deliver to PO Box addresses. I am assuming Fedex delivered your package to the actual address instead of the PO Box. I would check with Fedex if the package was delivered.

I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?

- Was the I-134 part of your I-485 application, or was it part of your dependent's?
I am asking this because there is no instruction regarding such an affidavit in the Initial evidence section of the I-485.

My 485 case is pending under EB3 category but my employer has already filed for EB2 labor which got approved and now I want to know if I can apply I140 for EB2 to interfile under 'Premium' Category? Are there any restrictions on applying I140 under premium processing?
