    Hello gurus..

    I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?

    All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

    subract all business expenses (Corp/ LLC/ Proprietor)
    thats the nett business income to be reported while filing taxes

    My spouse qualifies under cross-chargeability, she filed her I-485 application after mine, with me as the primary applicant. I never mentioned anything about cross-chargeability in my application.

    Now the PD is current for "all -other chargeability" how do I check if my I-485 application is going to be picked up?

    Any ideas how I can do that?

    My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
    It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
    I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
    They say they can refile again .. but duno what to do ??
    Can anybody be kind enough to help me out here!
    I am so frustrated that I feel like going back to home country now.

    I am on H4 visa, based in Georgia. Did anyone get �Change of Maiden Name to Married Name� done on passport from Indian Consulate Houston, TX.
    Can anyone tell me what am I supposed to write in the �Surname� column in the new online application form ? The old application had 2 columns, 1 for maiden name and the other for Desired Name, but the new online application form has only 1 Surname column. I am confused as to what should I write � my maiden name or my married name. I do have the notarization done on the affidavit form. Does this give me the right to write my married name ? Which name should I sign in the application- maiden or married name?
    AlsoI have heard that anybody submitting �Change of Maiden Name to Married Name� application in person, to Indian Consulate Houston, has to collect the new passport at the counter in person, the passport will not be mailed to him/her. The passport is only sent by mail to those who have sent the documents to Indian Consulate Houston by mail.
    Is it true?

    Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

    Please help!

    I don't think so. One of my friend is in same situation. I feel 485 is filed after H1b so every thing is fine. But on which boat they need to travel is the question? you can't use H1 if you use EAD?

    Hi All:

    I am on H1-B visa. I also have I-140, EAD and AP approved recently. I plan to send paperwork for my mom's tourist visa. Do I need to send I-485 receipt notice and copy of EAd or is it OK to send copy of latest H1-B approval?

    LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

    We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.

    We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.
